[net.aviation] Flying Clubs

wolenty@inuxd.UUCP (R Wolenty) (10/28/84)

We are planning to start a flying club with six members
buying in on an Archer. I'd like input from members
of other organizations about how their clubs are organized.
In particular, are you incorporated? If so, what type
of corporation are you organized as and what is your tax
status? Also, has anyone had any experience with lease-
backs? While sifting through the options I would appreciate
any help from those who have already traveled this route.

					Many thanks,

Something to check into is your local laws.

Here in Arizona, over 80% of the state law relating to aviation
is a terribly stringent set of regulations on "flying clubs".
My (layman's) interpretation is that the government does not want
a business (FBO) to escape taxation simply by calling itself a
"flying club".

One of the ways that a group can establish itself as a "flying
club" rather than FBO is to allow only members to fly, and all
members must be at least part owners of the aircraft. In other
words, no renters. Further restrictions on commercial activity
such as flight instruction and charter work are usually required.
