It does not matter if the patch is simplex or whatever. The legality of its use lies in the fact that the system must have a separate control frequency, just like a repeater. The control link must be 220 MHz or above, or a landline that is not used for the patching itself. Since simplex patches are more likely to be used by individuals, where duplex patches are usually on a already properly controlled repeater, it is more likely that the simplex patch will not be used legally.
