The author of the followup to my comments was quite perceptive in recognizing that compilations and collected works, such as indexes, bibliographies, etc. (not copied in toto from another copyrighted work), may be copyrightable. The Constitution and statutes have construed "original authorship" to apply to any work which is the product of an individual's efforts which exhibit some minuscule amount of intellectual labor.
