On January 8, 1991, CompuServe's Online Today released a story submitted by reporter/contributor Charles Bowen concerning yet another E-Mail privacy lawsuit. It is important to note that I could find no other verification for the information provided by CompuServe's Online Today and Charles Bowen. What follows is a section of the E-Mail privacy story, as it appeared on CompuServe's Online Today. ===================== TEXT BEGINS ===================================== NISSAN NAMED IN E-MAIL LAWSUIT (Jan. 8) Nissan Motor Corp. has been named in a suit alleging the car maker illegally eavesdropped on private electronic mail of two employees. The suit, filed in the Superior Court of California, seeks unspecified damages for Bonita B. Bourke and Rhonda L. Hall, who were employed at the Carson California facility of Nissan as information systems specialists in the Infiniti support group. In a statement from Los Angeles, attorney Noel Shipman, representing Bourke and Hall, says the suit accuses Nissan of invasion of privacy, violations of constitutional right of privacy and wrongful termination of employment. ======================= TEXT ENDS ===================================== According to Bowen, the two information systems specialists were confronted by company management with hardcopy of their E-Mail and told that they were risking termination of employment for using company software for personal messaging. Bowen also points out that Noel Shipman is asserting the information specialists were given the impression that E-Mail was unmonitored and all were encouraged to make use of private E-Mail when needed. Finally, Bowen revealed that some of the E-Mail was published for other members of the Infiniti group to see. Walter
