One comment, then I'll sign here. There is another issue, that legal or not, in order to be prosecuted, one HAS TO CATCH YOU doing it. I think that a good number of people are protected in the scanner environment by laws precluding unreasonable search and seizure (even if what they are doing may be interpreted as being illegal).
