I suggest that trial.misc.legal.software is the best place for this
discussion (transported from rec.games.programmer).

``Fraudulently'' is the word. Unless, of course, C can prove that the
copyright was assigned to him.

Trade secret law is the best way for A and B to make it excruciatingly
painful for C to steal their code.
