Notice that entering a house through an open door or entering upon land via an open gate mitigates the charge of trespassing unless the owner or agent reaffirms property rights by signs, statements, commands to vacate, etc. Perhaps the same principle should apply to computer access. If one doesn't attempt to protect one's system, no claim of intrusion can be brought. (Unfortunatly the lawyers will have to argue about degrees of attempts to protect the system, SEE net.politics).
