AMERICANS/DISABILITY-ACT
To : ALL (source: Jay Bond at Rep. Craig Washington's office)
Five amendments were considered Thursday, May 17, to the
Americans with Disabilities Act. Four passed; only one was
defeated.
Amendments: 1. That a written job description could be used
by an employer as a defense in court. Passed. 2. Delayed phase-in
for small business. Large employers have 18 month to phase in
compliance with the ADA. Employers with more than ten and fewer
than 25 employees have an extra six months. Employers with ten or
fewer employees have an extra year. Passed. 3. Amendment regarding
access to wilderness areas. Passed. 4. Provision that if an employer
spent more than ten per cent of a year's salary to make a job position
accessible, then requirement of access would be undue hardship.
Defeated. 5. The "Chapman Amendment" -- to allow employers to
transfer employees with infectious diseases away from food service.
(The amendment is about AIDS.) Passed.
Still to be considered Tuesday: 6. "Simpson-Brenner" amendment
which would limit remedies for violation of ADA. The Senate version
of the ADA gave the same remedies as given in the Civil Rights Act

of 1964. 7. The "One-Car" amendment which would in effect repeal
part of the Rehabilitation Act of 1973 and require AmTrak to have
only one car per train accessible. 8. "Schuster" Amendment that
would exempt transit systems of cities with less than 200,000
population. Final passage expected Tuesday.
THE ADA NEEDS YOU! The weakening amendments are
getting approved! Call (202) 224-3121 to YOUR Congress-Person!
