So, how can I contribute here?
By showing you how to successfully file an insurance claim, and get
the money you deserve, without hiring a lawyer.
Most people hire an attorney because they simply run out of patience
with the whole process and don't want to hassle with it. Some run out of
patience about ten minutes after the accident, others take longer.
It is simply a matter of proving your claim. I tell all of the people I
deal with this, it is no real secret. A tort is a civil wrong. It is
based on a principle that one person owes a duty of some sort to
another. If you drive on the highway, you owe the other guy the duty of
respecting the laws, yeilding the right of way to others, not drinking
and driving etc. If some breaches that duty, lets say, rear ended you in
a car wreck, then you have the beginning of a claim.
The next part is that you must have damages. Damages that are directly
related to this breach of duty. You must be able to prove both of these
points before we go any further. A police report, showing the other
driver was ticketed, or independent witnesses (a guy on the corner, not
another passenger in your car) that can testify that the other guy drove
into you, can establish this. It is not always clear cut as to who's
fault an accident is, most states use "comparative negligence" of some
form or the other. You may not be more than 50% at fault for your own
injury and collect. If the person who did the damage is only 60% at
fault, they only owe you 60% of your damages. Don't get upset just yet,
it gets better.
Before I get too deep into this, does anyone really care about this?
I'll shut up if you don't want to learn.

Well, not really that interested in taking a claims class with you at this
time. Already attending one on a full time basis. (This type of claim is a
first for my adjustor & of course myself.)

I'm using a lawyer on only the civil matters at this time. I agree with you
in ragards to just running out & getting a lawyer in regards to standard
insurance claims. All he'll usaully do is make phone calls & take a big
chunk of the settlement. I can make phone calls just as good as he can,
maybe better. It seems that I may have to add some lawyers to my insurance
claim to clear up interpetation of Michigan auto. no fault laws.

Keep talking - you are beginning to sound like you REALLY do care
about people that have been grievously injured. My apologies for
misreading you initially...
