Index Number: 12459 Jamal, you may have a real good breach of contract lawsuit here. They promised your realtive publicly in media that was broadly spread to many people a scholarship. Then when he gets married the day before the convention, they recind it. With the same flourish that they gave the scholarship they could just as easily in the exact same documents of brad dissemination given the "you must be here the day before convention" stipulation. Failure of them to do so constitutes fraud and deception in awarding of a prize. This may well breach charities law in your relative's state. and your department of state and attorney general can help you sue them I would take that tact if I were you. It seems NFB gets away with murder too many times anyhow. This is a slap in the face to family and marriage and trust of human dignity and self-dertermination. Go for it. Index Number: 12487 Thanks for your message explaining the basis my brother would have had for a lawsuit against the National Federational of the Blind for retracting a scholarship after he told theme he could not attent an un-publicized preconvention meeting due to his wedding. In protesting this retraction, I did say it was "possibly illegal." Apparently the national office felt the organization was sufficiently at fault that they decided to give him money instead from the American Brotherhood for the Blind, which is also controlled by national NFB leaders (Dr. Jernigan, is Executive Director of both organizations, and Mr. Maurer is President of the Federation and General Council of the Brotherhood). My brother and I were asked to keep quiet about this grant of money to him. He received no public recognition at the NFB convention in Dallas unlike the other scholarship winners, yet was still expected to meet with an NFB "mentor" almost every day of his stay there on his honeymoon. We did in fact keep quite about this resolution of my brother's case until it became clear that the head of the NFB Scholarship Committee was exercising a vendetta to expel me as a member because I had gone over her head to the national office after he declined to reconsider my brother's case. The NFB then used the charge that I had "alleged illegalities" committed by officers in its decision to expel me as a member a couple of weeks ago. From what you say, Idid in fact have a legal basis for protesting the retraction of my brother's scholarship, though I never actually claimed it was illegal, just "possibly illegal." Any other insights you might have on the conduct of the Federation against me would be of interest to me. Index Number: 12699 Jamal, I would suggest you do a couple of things with the Federation. First accumulate all PUBLIC mention of his scholarship. Collect the publicity about the rules and scholarship from the media that attracted your brother to it. All pertinant rules should be in those rules. If not, and then they imposed a "separate discretion", you have an actionable offense here. The Department of Charities in the Maryland area would be able through their Department of State what is called an "administrative malfeasance" and your State Attorney General could also call it a "charity fraud and mis- representation". They treated you with impunity for some "unwritten rule". They also retaliated against your relative during what is called a "major life event of significance" in requiring he meet a "mentor". He was on his honeymoon and it was pretty clear. He also planned his wedding around the "major life event of significance" as part of his plans of celebration. He was bringing his bride! (for gosh sakes!) in a pride for acheiving the scholarship. If none of the materials for receiving the scholarship statd a "separate criterion of behavior" (such as coming to a meeting before the convention) he has an action. Remember NFB solicites money through the US mails and through various ways. They mention the scholar- ships everywehre in their solicitations. They may well have even in a solicitation for funds mentioned your relative. This acrues a "sympathy factor" to those who want to donate funds. If there was ANY publicity at all COLLECT IT and keep a file of it. That includes the Moniter and all other places the scholarship and its affilates advertise. (such as local papers and publicity of the federation and in local media.) In all, they have been misrepresenting publicly how they disperse the funds for scholarships if it came through the "Brotherhood" rather than the Federation. You have a clear case of charity fraud here. Both locally to your state and Federally through US Department of Internal Revenue 501 c 3 status. They viol- ated the method of honest solicitation. Where did his scholarship go? *NFB* gives scholarships. NEVER have I heard of the Brotherhood doing so. All bad faith and illegal misrepresentation of their non-for profit status.
