The issue HERE Joe is that kids DO on the aggregate have the OPTION
if they want it for summer school. FREE summer school.. and if
NONdisabled kids have that option DISABLED kids as an aggregate
should have that option too. Else it is not equal protection under
the law. If a parent wants a kid to go to summer school the courts
have in about 180 volumes of case decisions said it is a property
right of that child to get it. That is how ALL civil rights and
educqiton laws have been settled. from Bilingual ed to women's
equity ed to bi-cultural ed, to special ed, to english as a second
language and testing thereof to remedial ed (chapter 1 stuff) etc..
YOu nor I nor any ONE PERSONAL opinion is NOT going to squelch it.
And I think you should learn that these were hard fought battles.
And good ones.

That kid won the right. As do ALL kids who want summer school.
Disabled kids are NOT a suspect class. They are like any other kid.
They need reasonable accomodation and have won that right in the IEP
process... just as a non disabled kid can register in sumer school
so should disabled kids have that ease of choice and indeed this
decision loudly proclaims it.
