What sounds fishy is the statement by one of the witnesses that the
person that 'walked away' from the accident was saying 'sorry, guys'
as he helped the others out of the wreckage.

It says third _passenger_.  One pilot and three passengers.

What sounds _fishy_?  But then all plane crashes seem mysterious to those of
us who only go along for the one-way ride.  Sounds like a classic stall-spin
to me.  The trees either made it survivable or caused it in the first place
(depending on how far along the recovery from the stall was).
