It can be proven to be the trailing car's driver's fault if negligence in operator reaction can be shown. However, this is probably rather rare, and, unless there is a large damage settlement in the offing or obvious reason to believe that the trailing operator was negligent, then the citing officer would probably cite the operator who cut in front for clearance or reckless op.
