Morally, of course, the dealer should refund their money.
The law (which involves laywers and politicians and has little
to do with with morality) may be another matter.  However, you
may still have a good shot.

Some general advice though on putting down a deposit: Because all
car dealers ask for one, like it or not, you may someday be forced
to do this too.  When I leased my new Supra, they did not have one
to my liking in stock.  So, before I handed over a check and signed
the purchase/lease order, I had them write on it: 5 speed, no sunroof,
cloth interior, black exterior.  I knew at the time that I would
probably settle for something different (metalic blue with a sunroof,
in fact), but by having this in writing I maintained all my bargaining
power.  They didn't give me any trouble about putting this in writing.
I simply told them I wanted it in writing so there would be no
confusion or misunderstanding later on about what I wanted.
