[net.micro] Copyright laws out-dated ?

I read somewhere that object code technically does not fall under
the copyright laws. Has this ever been put to test in a court
decision (out of court settlements don't count)?  
The reason being that object code is not the work of the author, 
but the work of a machine, and that you can not transform the
object code back into the source.

Sure, the courts have ruled that copyright laws govern theft of object
code.  Isn't that what the Franklin ACE/Apple case was all about?  And
didn't Franklin lose, hands down?
