We are creating a e-mail user's guide, and would like to include a disclaimer about the privacy of e-mail. I believe this is especially important given the pending lawsuit against Epson for alleged e-mail violations. Does anybody have a disclaimer/warning statement they'd be willing to share? If you don't want to post but would like me to keep it confidential, please e-mail or snail mail it to the address below. One final note... our CD-ROM turned up an article in the 8/20/90 issue of Information Week (p. 53), but we don't subscribe & the nearest library that carries it is 50 miles away. Sure, no problem. Rsiatl is a public access site in Atlanta. Here is the relevant portion of our agreement that each subscriber signs off on prior to gaining a login. Each prospective subscriber signs the last page and initials each individual page of the agreement. At least they can't say they did not know about it. -------------------- ECPA NOTICE The Electronic Communications Privacy Act requires we notify you if we do not offer the privacy of email and files accorded paper mail. You are so notified. You should assume that any email or other communications may be seen by others, either because of software problems or because we reserve the right to examine any file on the system if we feel it necessary. We will do what we can to protect your privacy and will not disclose any information we may see by reading private communications other than to law enforcement officials. If we see evidence of illegal activity being conducted through this system, we will take all steps possible to stop it up to and including involving law enforcement. If you want (relatively) assured privacy, put it on paper, stick it in an envelope and attach a stamp. SS WARNING As you may have read, the Secret Service (the modern day SS) has made a mockery of First, Forth and Fifth Amendment rights as apply to electronic communications. Specifically, they currently have seized the right to grab computer and other equipment and bring charges against the owners based on the content of traffic passing through the system or stored therein by users. This, in our opinion, is one of the worst assaults against our Constitutionally protected rights the government has mounted in modern times. While hopefully these Nazi-like actions will eventually be overruled in the Supreme Court, WE are currently at great risk. You, the user could conceivably cause all the equipment at RSI to be seized without due process by virtue of something you say in email or on the net or by virtue of some file you place on the system. Therefore, as much as it pains us to do so, we must protect ourselves. (Punishing the innocent again.) Thus, we require that you not post anything or send anything through E-mail that may contain information some company may consider proprietary (Especially the shadow government- companies like AT&T or IBM). We further require that you not place any files on our system that may be considered proprietary by someone. And finally, we reserve the right to examine any file in your account. You explicitly agree by accepting an account to provide us with any passwords necessary in order to examine encrypted file contents. You further agree to completely endemnify us, defend us and hold us harmless regarding anything you may do or say while on our system.
