In the Winter 1991 issue of the _Journal_of_Economics_Perspectives_,
there is a sequence of four articles on Intellectual Property.

1. An Introduction to the Law and Economics of Intellectual Property
	by Stanley M. Besen and Leo J. Raskind.

2. Standing on the Shoulders of Giants: Cumulative Research and the Patent Law
	by Suzanne Scotchmer.

3. A Patent System for Both Diffusion and Exclusion
	by Janusz A. Ordover.

4. Some Economics of Trade Secret Law
	by David D. Friedman, William M. Landes and Richard A.  Posner.


I think these are useful reading for people interested in the
problem of software patents.
