Uh, that's a "feature," not a bug, of Finder. MultiFinder-aware applications (which, oddly enough, Finder is) can set the "Get Front Clicks" bit in the SIZE resource. Finder is one of the few applications which actually sets the bit. It does cause background Finder-windows to zoom if clicked in the zoom-box (even though it's invisible), but it also means you can drag windows around the desktop without having to select one to bring Finder to the foreground, then *re*-select the window to drag it. If it really bothers you, you can always turn off the "Get Front Clicks" bit in the SIZE resource using ResEdit (1.2b3 should have the correct SIZE template).
