I am currently involved with the development of a BBS program for the Amiga. We are rapidly approaching commercial release, and we are starting to think about the legal matters that accompany such a step. Specifically, we are worried about the use of our product name, "DIALOG Professional". The problem is that there is a large online database system called "DIALOG" and we are worried about TradeMark infringement. We intend to consult a lawyer on this matter, but I thought I'd post here to see if anyone has any experiance in this area. Thanks... -- Mike Oliphant UUCP: alberta!herald!telepro!oliphant Internet: oliphant@telepro.uucp FidoNet: (1:140/91) - ZMH only * * Call TelePro, the development system for DIALOG Professional * * Phone: +1 306 249 2352 2400/9600/14400 bps HST * +1 306 652 2084 300/1200/2400 bps * FidoNet: (1:140/90) *

I remember a few years back when we were working on a game that was then called "Sink the Bismark" or something like that. We ran into troubles because a BOARD GAME from years back had a name somewhat like that. It eventually had to be realeased as "Dive Bomber" to avoid the hassles. I believe Lotus had to pay off someone to use the name Magellan. Basically, when in doubt, change the name, or ask them directly if they think it would be a problem, and if they don't get written permission. Explain that the BBS and the Database are completely different types of programs and should lead to no market confusion. -- David Plummer - via FidoNet node 1:140/22 UUCP: ...!herald!weyr!70!David.Plummer Domain: David.Plummer@f70.n140.z1.FIDONET.ORG Standard Disclaimers Apply...
