As to Kirks competence, other than not raising his shields faster when the Reliant was behaving mysteriously (although the half quoted regulation may have something to do with that) and the beaming down of top officers into hazerdous areas (with or without armed escort consisting of 1 or 100 men), but that's Star Trek tradition, he made, in my opinion, militarily speaking, sound decisions. I believe it was clearly implied (by the half-quoted regulation) that when performing a rendevous with a ship that refuses communication or is apparently unable to communicate, the regulations require that the shields be raised. I don't suppose that Star Fleet Command intends to censure our hero for bungling it, however.
