[net.news.stargate] Broadcast to "subcriber" status?

After reviewing the stargate article in ";login:" and the msgs in
net.news and net.news.stargate that we've got here I'm going to jump
into the fray and suggest yet another alternative to complete moderation
of all the news that would flow through stargate.

In a nutshell lets:  turn news into a subscriber service

Means: data encription (it need not be "uncrackable" just encripted) and
a subscriber fee (small enough to not be a bother yet large enough to be
accepted legally).

Implementation: Any site who wants news via stargate "subscribes".  They
are given a data decription method/password/box for a fee.

As I read the law this would move stargate from a "broadcast" service
(with all those content problems which have already been discussed) to a
"subscriber" service (something like cable TV).  As far as I know, cable
TV is able to show a much wider range of material, which could not be
shown on the air because they 1) can't be received by the general public
and 2) folks are paying to receive this material.

Can some legal folk on the net determine if this changes the status of
the stargate tranmissions sufficiently to allow unmoderated news to flow
through them?

PS.  I'm **NOT** against moderation (let's not hash that up again) I'm
just trying to suggest yet another alternative to moderating EVERYTHING
that goes through stargate.  I think moderation will increase the
quality of news but unmoderated groups via stargate would be nice as
well.
