[net.misc] Is Jo-Jo a rapist?

ark (09/03/82)

According to Associated Press, the answer is "not quite." He was
convicted, not of rape, but of sexual assault. The difference is,
according to New Jersey law, in whether or not physical force is used.
In this case, apparently, he got a 14-year-old girl drunk and then
had his way with her when she was too zonked to resist.

The AP account leaves much unsaid. The bare facts encompass quite
a range of possibilities. Near one extreme, he might have decided
in advance what he was going to do and really put pressure on her
to consume all these high-powered drinks so she would be unable to
fight him off. At another extreme, she might have decided to seduce
him, and her relatives decided to cry rape. While my own biases are
that the first extreme is more likely than the second,
the account does not distinguish them, so I don't know.
