An apostate (or atheist) Jew is according to the HALACHIC codes "not a Jew 
for ANY purpose".  (Of course that does not "free" him from obligations.)
His "rights" (in this world) are NOT restored upon repentance
and he is NOT reaccepted into the Jewish community (Maimonides).
