[net.legal] Unreasonable lawsuits

A couple of weeks ago my in-laws car was hit in a parkinglot by an unattended
car that had come adrift (it just rolled into theirs).  The operator of the
errant car said to send her the bill for the damages and that she'd pay (it was
like $100 max, a little scratch on the paint and a small mark on the bumper).
My in-laws (wisely it turns out) filed a claim with their Insurance co. (Auto
Club).  Monday (18th June) the woman sent them a bill for repairs on her car.
This upset my mother-in-law to no small extent, the auto club said to sue the
woman in small claims court for the dammages as she was probably going to sue
them (in small claims).  I suggested that since they have already filed a claim
that they wait for her to sue them, then if she does file a Real suit
(for real bucks) in a real court for false suit (or whatever is reasonable)
and that they should go to one of the Legal-aid clinics in anycase.
Needless to say they are very upset (to say the least) about the whole thing.

  The question to the net at large is:  What would you do in this case?

I'll summarize any direct mail answers, but I think that this would make a
reasonable topic for general discussion.

Since the incident was reported to the car insurance company,
I don't understand why the owner was told to go to small claims
court. 
The woman whose car did th damage should be referred to the insurance co.
