[net.legal] Fired Workers Sue Former Employers

An article appeared in my newspaper about a year ago quoting an
issue of "Inc." magazine which said that the newest wrinkle among
terminated employees is "management malpractice" lawsuits. These are
especially prevalent in California, where 26 of the last 29 lawsuits
along this line were settled in favour of the former employees. Since
1975, the number of suits has increased 15-fold, with fired employees
suing for everything from "unjust dismissal" to "emotional distress."
Juries are quite generous with some of the rewards. One fired worker
demanded $100,000 from his former employer and got nearly $5 million!
Increasingly, courts are affirming the "job as property right" concept,
meaning that an employee is entitled to his job as long as performance
meets the grade.

Legal opinions, anyone? Looks like a good can of worms to open for
discussion.
