NOTICE TO ALL CALLAN DATA SYSTEM OWNERS ======================================= I had several informative telephone conversations today, and feel that the result of these is reason to warrant a posting to net.general. ALL FOLLOWUPS SHOULD GO TO NET.LEGAL ==================================== Despite popular belief and the statements made by an ex-CALLAN DATA SYSTEMS employee (Tim Smith), CALLAN DATA SYSTEMS is NOT bankrupt. CALLAN DATA SYSTEMS has not filed for protection under Federal Bankruptcy Law. However, CALLAN DATA SYSTEMS is closing its doors, and most employees have been let go. What CALLAN DATA SYSTEMS is doing is as follows: There has been a "general assignment of company assets" to the CREDIT MANAGEMENT ASSOCIATION OF LOS ANGELES. A person by the name of Lee Fortner, is handling matters for CMA of LA. CMA of LA, plans to hold a private auction of the assets and pay off "select" creditors at the rate of 70 to 80 cents on the dollar. CALLAN DATA SYSTEMS has all ready sold "the technology" for the UNISTAR series of computers to RICOH. It is not clear yet what the implications of this are. One item of concern is that RICOH has not expressed its intention about what it plans to do with the "technology". Since several boards in the UNISTAR 300 were made by CALLAN DATA SYSTEMS the likely hood of being able to obtain spare parts is low if not nil. Therefore, the value of a CALLAN UNISTAR 300 has dropped drasticly. Users, who I have talked to, both those selling 300's and those wanting 300's, are looking at a lose of $15,000 a machine. The user who wants to insure that he can keep present 300's running is looking at buying complete 300's as spares. CALLAN DATA SYSTEMS has canceled as "null and void" all software maintenance agreements. The software maintenance agreements were paided for a year or two in advance. Therefore, end-users who had software maintenance agreements are now creditors of CALLAN DATA SYSTEMS. However, CMA of LA will not respond to request for the forms that an end-user must file in-order to be considered a creditor. The purpose of this posting is to inform users and also let other computer users see what may happen to them. CALLAN DATA SYSTEMS users have an alternative to just sitting back and watch themselves be raped by a company with no sense of public fiduciary responsibility. An attorney also a CALLAN DATA SYSTEM end-user Bernard Karwick and I discussed today the option of end-users forcing CALLAN DATA SYSTEMS into involuntary bankruptcy. By doing so the court may reverse the sale of the "technology" to RICOH and force a sale to the highest bidder. Also, users who had software maintenance agreements canceled would receive recognition as creditors in the eyes of the court. I urge CALLAN DATA SYSTEMS end-users to call Bernard Karwick.
