[net.legal] I've been wanting to post this for awhile...

frye@cuuxb.UUCP (frye) (02/07/86)

I'd sure like to post this to net.women too. Only
trouble is, I can't get at that group from here
anymore. Some of you folks might want to point this
article out to some of your friends who don't read
net.legal too often.

My sister had some trouble with her husband becoming
abusive. She ran him off once for that crap. He got
to acting like he'd cleaned up his act and she took
him back. Everything went okay for a while. They started
a business (bought a bar in Aurora) and they started to
make a little money at it. It looked, for quite a while,
that they were going to be just fine. Then my sister saw
she was startingto miss money out of the register. She
kept her eyes open for a while and found out it was going
up her husband's nose. Sherry doesn't have much of a sense
of humor when it comes to drugs. She ran him off again and
told him to stay gone this time. He did for a couple of
months. Then he started calling her and threatening to
kill her and everyone she knows. She got in touch with me
and I loaned her a gun. (But not until she went to the
range with me.) About 2:30 or 3:00 in the morning on the
18th of December (the passed Dec.) Jackie kicked her door
down and started thumping on her. She got away long enough
to get the gun. Then she told him that all he had to do
is walk out the door and disappear. Jackie grabbed his
coat, but instead of putting it on, he slung it at her.
She just opened up on him. That damned fool just kept
coming at her until she had pumped five rounds into him.
I guess he caught on that he might be hurt because he stop-
ped then. He looked down at himself and said, Jesus Christ
woman, you've got me shot full of holes. Maybe you should
call an ambulance.

Well, Jackie spent 10 hours under the knife where they
put his arm back on. (One of the .357magnum rounds nearly
took his arm off.) They had to let his lung pump itself
back up where two rounds had poked entry and exit holes in
it. They had to do a colostomy on him 'til his colon heals
from the two rounds that tore it up.

Meanwhile, my sister was charged with aggravated battery.
The judge who was supposed to set her bail didn't buy that
though. He let her walk on her signature. She's been work-
ing two jobs trying to get out of debt and had to default
on buying the bar. Her almost dead almost ex was out of the
hospital in time to make a circus out of the first court
date. The only constructive thingthey got done was to put
a restraining order on him. He was not to contact her in any
way, not even by phone. Well, he was on the phone to her
the very first thing the next morning...

See, we've heard from different people that Jackie did some
nasty things just after Sherry kicked him out. He wants ab-
solutely nothing to do with cops, shysters or bench pounders.
Besides, she did him a favor. He's off funny white powders,
he had to quit smoking and he lost some of the fat that caused
him to weigh 230 pounds. He just gave up drinking too while
he was at it. I have to think that the bullets through his
colon must have been like a lobotomy for him.

Meanwhile, a new court date was set up because he disrupted
the last one by yelling at the State's Attourney a lot. The
new court date was yesterday (02/06/86). They actually got
something done then. They talked to Jackie and Sherry and got
both sides of the story. Jackie seemed to be in one of his
rare states of having his mind with him instead of leaving
it at home. He told the judge that he did kick the door in
and start beating on Sherry. If he hadn't done that, she would
not have shot him. He could press charges andget the case into
criminal court (these two thingies were just hearings), but
the judge thought the ground Jackie was standing on was pretty
wobbly. The State's Attourney was so mad at Jackie from the
trouble Jackie gave him over the whole thing...I think he
had figured out why the fool got shot in the firts place. So,
the State's Attourney said he'd let it slide if Jackie would.
That'd be one way Jackie would be out of the guys hair. So,
they turned Sherry loose. What worries both of us is the
fact that Jackie could just take matters into his own hands.
He's been known to do stupid things like that. The two lawyers
who represented Sherry had already thought of that. They've
already started to do whatever it takes to get Sherry's gun
back. Meanwhile, I've loaned her another one...And, I doubt
anybody will think too much about it if he kickes her door
down again. Also, she already knows where not to shoot that
fool. She'll try some new places if there is a next time.
She also knows I was right when I told her not to stop shoot-
ing 'til he stops coming towards her.

There is something a lot of folks don't know. You can take
some pretty big iron to someone's person. And, I'll pretty
much garauntee you that you can kill someone with any gun.
Only problem is, what's he doing while he's dying? Size of
the gun doesn't matter too much. If the fool doesn't know
he's hurt, he's liable to keep trying to do whatever it is
you shot him for doing. You can't stop 'til he stops. They
tell cops that right off. Why is it that they don't expect
a civilian to know anything like that. That was one of the
questions the S.A had regarding the case. She told the guy
that Jackie weighed in at 230 and she only weighs 110. She
thought it would be better to keep shooting than to let the
fool get a hold of her.

I'm glad it didn't get as far as criminal court, but Sherry
knows so many people who don't trust Jackie anymore (they
used to). Her attourneys wouldn't have much trouble finding
witnesses to back Sherry up. Most folks who know her know
she hasn't even had a traffic ticket in the past 10 years.
They also know she doesn't even like guns. They also know
that fact won't prevent her from keeping one around from now
on...And I still think Colt and Smith&Wesson can do wonders
to counteract vast size and weight differences. The only thing
I must say is, if you decide to pick up some iron, realize
that you will have to answer a lot of questions if you use
it to defend life and limb. Please be damned careful and
considerate. You may be making a life or death judgement.
That can be real tough if you're talking about someone elses
life that you may have to take. Its bad enough just having
to worry about your own life.

'Course, guns aren't any more dangerous than cars. If you
feel somewhat out of control on a particular day, that's
the best time to leave the car parked and the gun in the
drawer with your underwear or socks.
