The fight goes on to overturn the Accomack County ordinance which
effectively closed Assateague Wildlife Refuge's clothing optional
beach. Here's an except from NCN's newsletter, The Capital Sun:
"National Capital Naturists, Inc., and individual Naturists,
nudist and non-nudist plaintiffs have filed suit in the United
States District Court, Eastern District of Virginia in Norfolk,
against the Accomack County Board of Supervisors, the Accomack
County Sheriff and the Commonwealth Attorney. The action is for
declaratory judgement that Section 9.3, County Code, County of
Accomack Virginia, 'AN ORDINANCE PROHIBITING PUBLIC NUDITY IN
THE COUNTY OF ACCOMACK VIRGINIA', is unconstitutional. NCN is
seeking three things on behalf of itself, its members and
ultimately, American citizens everywhere:
1) Preliminary and permanent injuctive relief from future
arrest and prosecution by law enforcement officers of the County
of Accomack, Virginia;
2) Declaratory judgement that the ordinance is patently
unconsitutional in violation of the 1st, 4th, 5th, 9th and 14th
amendments to the Consitution of the United States and Article
1, Sections 1, 8, 11, 12 and 16 of the Consitution of Virginia
and penumbral rights emanating from these express consitutional
rights; and
3) A judgement awarding to NCN, Inc. attorney's fees and costs
incident to the action."
