[From Mo 7 Nov 1983 Montgomery Journal] A bicyclist listening to music on stereo headphones as he crossed a railroad track didn't hear a train before it crushed him to death, according to police. Prince George's County [Maryland] police said Douglas Herzog, 18, of 7823 Mandan Road in Greenbelt, was killed at 8 a.m. Friday. They said it took hours to identify him because of his severe injuries. Seconds before his death, Herzog was stopped on a black 10-speed bike behind a truck, which was waiting at a crossing gate for a southbound train to pass. "When the train passed, the truck ran around the barricade before it raised (and) the bicyclist followed," police said. But a northbound train en route to Baltimore had reached the crossing and the cyclist slammed into it. He was killed instantly, police said.

I agree with you, why should people who can listen to headphones responsibly be branded outlaws, for listening on/in their wheeled devices. Your point about smarter people is great, Darwin lives...... Just think I can roll the windows up in my car turn up 40W of stereo to a +70db level legally.
