If you write a little menu program, then you can get around the "BRUN",
also I do believe that Apple charges a royalty for using DOS 3.3, but
I'm not sure how much it is.  You might check into Diveri DOS, David DOS,
or Pronto DOS, which are all DOS 3.3 compatible, and offer different
liscensing to publishers.
Now, I'm not saying this is right... but I'd have to say that there are
hundreds of publishers that have included DOS 3.3 on their software and
have not paid any liscense fees...  Personally I don't agree with the
DOS liscensing philosophy, but Apple does have a right to protect its
interests.
