[net.med] Physical examination and job disqualification

My sister-in-law was refused a job on the 
basis of her physical exam.  She is a nurse
and the job was to be with a hospital.

The question is:  Is the hospital/employer
required or responsible in any way
to inform her of exactly why the exam
flunked her?  The hospital personnel would
not tell her "why" nor would they tell her
what was found during the exam.

This is especially 
concerning to her because recently
she had surgery, she is
not young, she has no pension, and she
worries that this may happen again.

This obtaining medical information on a person, using it
on you, and then with-holding the info from you...Doesn't that
have a familiar ring.  The medical world has not been curbed
in the same way that the Credit Investigation services have
by the Federal Laws requiring that you have access to your
credit file ( once per year I think).  You also have the
right to file a rebuttal on any "bad" items in your file.

It is time we had similar protection in the Medical Investigation
field.

I remember a few years ago during a company physical my records
were on a table in front of me.  I picked them up and started
reading through all the details on ME (many of which I supplied).

When the nurse returned she about had apoplexy right in front of
me, snatched my file, and wailed something about my reading this
info as being "unprofessional". I still don't know what she was
talking about.  Any nurses out there care to fill me in ??

(I know..I know my company PAID for the physical, but they used
invasive procedures < needles etc > to obtain some of it and
put me to some inconvenience to get the info.)

I was under the impression that the equal opportunity act specified 
that employers must provide factual basis for refusal of employment,
if employment is contengient on a qualifying examination of any kind.

I would consult an attorney.
