According to a friend close to the industry (quote, unquote), GEM was designed by a formed Apple employee. When he joined Apple he executed a standard post-employment agreement. This agreement prohibited him from implementing look-alike products for some period after he left Apple. For some reason he didn't inform DR of this agreement. Perhaps he forgot, perhaps he didn't understand it, perhaps .... In any case, DR was in a defenseless position and had to accept any quasi-reasonable terms that Apple offered.
