I beleive it was in Monday's or Tuesday's USA Today paper that the
appropriate rules were spelled out.  One rule had to do
with pinetar on the bat and it clearly stated that if
it is detected in excess, then the bat shall not be 
allowed in play period.  Nothing about declaring the batter
out after the fact.  This principal was upheld in
Mayberry vs Angels.
The rule that applies when a batter shall be called out
because of an improper bat clearly states those reasons,
e.g. cork, sanded down, lead.  NOTHING about pinetar.
