The protest was upheld. I'm not sure what the reasoning was. However, I feel that the homer should count, even if the pine tar went to the tip of the bat. The illegality of the bat is an appeal position. The Yankees have admitted that they thought that THAT bat was illegal when he used it earlier. Once the Yankees allowed it to be used, they condoned its condition. That is, if it's illegal, it's always illegal. By accepting it once, they have said they waive their rights to have it penalized. They still could prevent him from using it, but they cannot erase what he does with it. This reasoning is used in many other sports and games and is also a legally acceptable argument in the courts.
