The only part of the FARs that would cover smoking on an air carrier
would be part 121.  This question intrigued me, as a question on 
smoking in the cabin would have made a beautiful ATP written examination
question, but there was nothing mentioned on the ATP written about 
smoking.  This got me to looking at FAR 121 last evening.

Not quoting chapter and verse, the only mention of smoking was that
it be prohibited during takeoff and landing.  Who, then, governs the
121 carrier concerning smoking if the FARs do not.  The answer is
the Civil Aeronautics Board.  The CAB regulates how the passenger is
treated, the FAA regulates the aircraft and operation from a flying
viewpoint.  Right now I don't know who will take the CAB function
when the CAB is disbanded (1984??).

So, the next time that you fly on a 121 carrier (TWA, UNITED, Republic),
look for the lit no smoking sign (required), the fully removable ash
trays (required) and don't smoke in the "blue room" (required).

I hope that this has confused anyone too badly.
